The court of appeals affirmed in part and reversed in part a judgment of the circuit court for Brown county, Alexander R. Grant, circuit Judge, which dismissed the plaintiffs' wrongful death claim following a jury trial. The court of appeals remanded the cause to the circuit court with directions to retry the case on the issue of liability. We affirm the court of appeals.
